ROBERT DOWNEY JR's scheduled court hearing tomorrow (21FEB01) is likely to be postponed - because the parties have not come to an agreement, prosecutors claim.

The CHAPLIN actor, who was arrested in November (00) for alleged drug possession, was due to have his fate in the case - which was postponed from January (01) - sealed tomorrow (21FEB01).

But now TAMARA CAPONE, a prosecutor at Riverside County Court, California, where the hearing is scheduled to take place, says it's more than likely the troubled star of American TV's ALLY McBEAL won't be taking the stand tomorrow (21FEB01).

Capone says, "We haven't reached a disposition yet, so we're simply going to continue it," adding that attorneys will seek a court date in mid-march. If convicted guilty of possession, Downey Jr, who has a history of drug use and has previously served 11 months behind bars for violating his parole, could face going back to prison for several years.
